Terms and Conditions

These Terms and Conditions set out how you (the User) can make free downloads or purchases of digital products based on other client services (a Download) from our Site, for example our meal plans or audio files.

Please read these Terms and Conditions carefully. We pride ourselves in providing a high level of customer service and ensuring that you are aware of your rights relating to your Download, as the case may be. Ahead of making any Download you will be asked to tick a box on our Site which says “I Accept the Terms and Conditions”. In ticking that box, you will be accepting the terms set out in this document.

We are based in the County of Kent, in the United Kingdom and our services generally are governed by United Kingdom legislation applicable in England & Wales.
If you have not made an agreement for our consultation services in this respect, specifically signed by us, then you are not our client and we owe no duty of care to you under any title whatsoever, whether you have acquired a Download or otherwise. These Terms and Conditions and any claim or dispute arising in relation to any Download will be governed by English law and the courts of England and Wales shall have exclusive jurisdiction to settle any such claim or dispute.

Our insurance does not cover us for products or services directly or indirectly provided in or made available to the United Stated of America or Canada and nothing in this document shall in any way bind us to the laws of those jurisdictions nor create any relationship with them whatsoever. Business in the United States of America and Canada is totally excluded from the remit of these Terms and Conditions and the scope of reliance of any Download. While we cannot fully prevent our digital documents from being downloaded from any jurisdiction in the world (and we are under no duty to prevent this), any non-United Kingdom application of a Download subject to these Terms and Conditions is not from us, it occurs against our wishes and the content made available shall not be capable of reliance in any way whatsoever. Still less has there been any attempt to relate any Download to any personal situation which shall be a matter of fact or opinion, for assessment against particular personal circumstances following consultation with a qualified medical professional, whether or not the person concerned or the medical professional finds what we say persuasive in their advice. None of that shall be imputed to us.

The Terms of Use for our Site and our Privacy Statement can be found on separate pages. It is always our aim that you will be fully satisfied with your Download. Should you have any questions about your purchase we will be happy to assist.

Terms and Conditions for Non-Customised Products and Digital Downloads

Without limiting the foregoing, we are proud of our Downloads and the feedback which our clients give to us, which shows that they make an impact. The Download is a digital file which you will receive via email link automatically once the agreement for Download is concluded (with any applicable payment having been processed).
The media file type of the Download is stated – and while we believe that the file will work on all media platforms, we accept no duty to verify this before you complete the Download. You can complete your Download and save the Download to your device, and copy it for your own personal use on other devices. You should receive the Download at the speed of normal electronic mail and, from the moment of transmission by us, you will not be entitled to receive a refund so do check that you are purchasing the correct product or service to meet your needs if this is a paid Download. Your other statutory rights to a refund remain in place in the usual way.

The Download does not come with any additional bespoke or continuing support. If you would like ongoing 1:1 advice please enquire about our 1:1 services.

We have produced our Downloads on the basis of requests from our client base, which does not mean that it is appropriate for every client or recipient. It is not an expert product and it is not made available as such . Our digital content should always be treated as for informational purposes only, it is not intended to replace (and it by definition cannot replace) professional medical advice, diagnosis, or treatment. Whilst our digital content discusses health-related issues, it is not designed for the purpose of diagnosing or treating eating disorders, or other medical conditions.

If you have an eating disorder, or any other health issues, you should consult your healthcare provider before engaging with our digital content.

By proceeding to accept a Download, you understand and agree that this is digital content and that JL Nutrition Clinic is not responsible for any adverse consequences that may result from the use of our digital downloads or any of the statements made within them. It is your own risk to have someone verify that this content is acceptable for you if you are not confident that you may do so yourself. In any event, you agree to use our products at your own risk and acknowledge that JL Nutrition Clinic is not liable for any personal harm or negative impact on your health, including any exacerbation of an eating disorder.

Please be advised that we reserve all rights to our intellectual property for both our customised and non-customised products and services. This means that whilst you are free to use the download digitally or print out a copy for personal use you are not permitted to copy, distribute, adapt, edit or share any of our products with third parties.

No warranty and no liability

JL Nutrition Clinic accepts no liability whatsoever on the basis of the content of a Download. All use of our Downloads proceeds at the instance of the person downloading it, which should know the risks associated with their own conditions, or should be guided by persons that know such risks in the event that they do not have the capacity to decide that for themselves. Nothing in this document imputes a duty on JL Nutrition Clinic to make any clinical assessment of a patient before or after they have or accept access to any Download. No warranty is given whatsoever with respect to any Download.
